    What is the difference between litigation and arbitration in the UAE? + -

    Litigation refers to dispute resolution through the UAE's formal court system — the Dubai Courts or Abu Dhabi Courts for onshore matters, and dedicated tribunals such as the DIFC Courts for common law disputes. Proceedings are conducted primarily in Arabic in the onshore system, with judgments enforceable across the UAE.

    Arbitration is a contractually agreed private process, administered by institutions such as the DIAC, ICC, or LCIA, and governed by the UAE Arbitration Law (Federal Law No. 6 of 2018). It offers parties greater procedural flexibility, confidentiality, and the ability to select arbitrators with sector-specific expertise. Awards are enforceable domestically and, for signatories, under the New York Convention internationally.

For contentious matters, litigation or arbitration, fees are structured as a monthly retainer combined with milestone-based billing aligned to procedural stages. Hourly billing is available where scope is genuinely variable. In all cases, clients receive a transparent fee agreement prior to engagement, with no hidden disbursements. JUR does not offer contingency fee arrangements, in accordance with UAE Bar regulations.
